SUB-DECREE

ON

The Implementation of Tariff Reduction and/or Elimination Schedule of the Kingdom of Cambodia based on the ASEAN Harmonized Tariff Nomenclature 2012 under the ASEAN Trade in Goods Agreement

 

The Royal Government of Cambodia

Having seen the constitution of the Kingdom of Cambodia;

  • Having seen the Royal Decree No.  NS/ RKT/09 13/903 dated  24  September 2013 on the composition of the Royal Government of Cambodia;
  • Having seen the Royal Government of the Kingdom of Cambodia;
  • Having seen the Royal Decree No.02/NS /94 dated 20 July 1994 on the Organization and Functioning of the Council of Ministers;
  • Having seen the Royal Kram No. NS/RKM/0 1 96/ 18 dated 24 January 1996 on the Establishment of the Ministry of Economy and Finance;
  • Having seen the Royal Kram No. NS/RKM/0297/03 dated 24 February 1997  on the Promulgation of the Law on Fiscal Tax;
  • Having seen the Royal Decree No. NSIR KM/0707/0 17 elated  20 .July  2007  on  the Promulgation of the Law on Customs;

  • Having seen the Royal decree No. NS/RKM/0 I 03/004 dated 20 January 2003 on the Promulgation of the Law on the Adoption for the Kingdom of Cambodia to join the Convention  on the Establishment  of Customs Cooperation   Council ;
  • Having seen Royal Decree No. NS/ RKM //0  I  03/00  I  dated  20January  2003  on   the Promulgation  of the Law on the Adoption for the Kingdom of Cambodia  to  join  the International   Convention  on  the harmonized Commodity Description and Cod in g System ;
  • Having seen the Sub-decree No. 488 HNKR.BK dated 16 October 20 1 3 on the Organization and Function of the Ministry of Economy and Finance;
  • Referring to the need of the Ministry of Economy and Finance

 

Decided

 

Article I.-

To promulgate the Tariff Reduction and/or Elimination Schedule of the Kingdom of Cambodia which not be implemented retroactively based on the ASEAN Harmonized Tariff Nomenclature (AHTN) 2012 under the ASEAN Trade in Goods Agreement. The Tariff Reduction and/or Elimination Schedule are set in the Annex of this Sub-decree.

Article 2.-

The Tariff Reduction and/or Elimination Schedule of the Kingdom of Cambodia as Referred to the Annex of this Sub-decree can be applied on the conditions that goods are originated from ASEAN Member States, with the Provision of Chapter 3 on Rules of Origin of the ASEAN Trade in Goods Agreement.

 

Article 3.-

Importers shall abide by Rules and Regulations set by the Ministry of Economy and Finance in implementing the ASEAN Trade in Goods Agreement.

 

Article 4.-

This Sub-decree shall be implemented in 30 days after the date of signature.

Article 5.-

Any regulations contrary to this Sub-decree shall be invalidated.

Article 6.-

Minster in charge of the Council of Ministers, Minister of the Ministry of Economy and Finance, Ministers of all Ministries, and Heads of all Institutions shall be in charge of implementing this Sub-decree respectively from the date of signature.
